Rosenstein calls Whitaker a 'superb' choice for acting attorney general

Fears for Russia probe as Trump fires Jeff Sessions

Whitaker was campaign chairman for Mueller witness

The Washington Post on Thursday, citing sources close to the acting attorney general, reported Whitaker has no intention of recusing himself from overseeing Special Counsel Robert Mueller's investigation into Russian interference in the 2016 presidential election because of comments he made about the investigation in his private capacity. Sessions had endured months of public abuse from Trump, who soured on Sessions because he recused himself from oversight of the Russian Federation investigation shortly after he arrived at the Justice Department.

Following Sessions' abrupt resignation on Wednesday, President Trump tweeted that Matthew Whitaker, chief of staff to Sessions, will become the acting attorney general.

Asked by ABC's Jon Karl about Whitaker's past criticisms of the Mueller investigation and calls for his recusal, Trump feigned ignorance.

Trump said, "No matter who I put in, they go after him ..."

Whitaker has questioned Mueller's authority to investigate aspects of Trump's election campaign and suggested how to end the investigation: by cutting its budget.

"It's not necessary. The Mueller investigation is not under threat", McConnell told reporters. The Senate's top Republican predicted a permanent replacement could be named soon for Whitaker, who is now overseeing the Trump-Russia probe.

U.S. Senate Democratic Leader Chuck Schumer cast doubt on the legality of Whitaker's appointment and sent Trump a list of questions about the move.

"I think fundamentally this investigation by Bob Mueller needs to be limited", Whitaker said during an interview with Sean Hannity in 2017.

He has two other options: make a report on his conclusions for the House of Representatives, which has the power to impeach the president.

McConnell, who sets the Senate's agenda, reiterated that legislation to protect Mueller from firing is unnecessary.

Trump has told confidants he remains deeply annoyed by the 18-month-old Mueller probe, believing it is not just a "witch hunt" but an expensive and lengthy negative distraction.

Critics worry Whitaker may be unlikely or unwilling to defend the investigation, given his history of partisanship and loyalty to Trump.

But as special counsel, Mueller didn't require Senate confirmation. And even if ethics advisers at the Justice Department suggested he step aside, Whitaker is not obligated to follow that advice, sources explained.

Gonzales resigned as attorney general under a cloud of controversy and amid accusations that the Justice Department has been used for political purposes.
