Odinga accused of fearing new presidential elections

On September 20th, nearly three weeks after the country's supreme court annulled the presidential election held on August 8th, the judges issued acomplete judgment to explain their ruling.

Deputy Chief Justice Philomena Mwilu in her remarks said that the election results were announced even though numerous electoral forms had not been received for verification and many forms did not tally with figures from polling stations.

"Though the petitioner claimed various offences were committed by the issues of the first respondent, that is the IEBC (elections board), no evidence was placed before us to prove that allegation", Maraga said.

On Wednesday it is expected to read its full decision with details.

Maraga refuted claims that the Supreme Court discredited the sovereign decision of the voters in the August 8 presidential election by annulling the election based on technology malfunction.

Since the presidential election was annulled, the judges said that the threats against them have "become more aggressive". Those measures were ordered by the court of appeal past year to enhance accountability and reduce incidences of electoral fraud.

While admitting that "no election is ideal", the judges in the majority said that IEBC had disregarded electoral laws and behaved as if they "did not exist".

"They are not merely technicalities but they are things that are protected and enshrined in law", said Nyabola.

Opposition coalition Nasa has been pushing for the sacking of IEBC officials whom it blames for bungling the polls, saying that a new team should be in charge of the re-run scheduled for 17 October.

Separately, a French company that provided equipment for last month's elections says the biometric and results transmission equipment would not be ready for the new vote next month because it would have to be reinstalled.

The four judges who decided in a majority decision to annul the vote also said the election commission had failed to verify the numbers before declaring Kenyatta victor.

The judges had ordered the re-run to be held in 60 days.

Maraga accused the inspector general of police of "repeatedly ignoring calls to act, exposing judicial officers, property and litigants to danger".

Supporters of Mr Kenyatta are unlikely to be persuaded by the ruling.

It comes as riot police fired tear gas at supporters of Kenyatta amid protests outside the Supreme Court.
